"The Company", "Ourselves", "We", "Our" and "Us", refers to Smikehost. "Party", "Parties", or "Us", refers to both the Client and ourselves.

Hosting Services

Smikehost provides shared hosting, VPS hosting, dedicated server, and reseller hosting services. By subscribing to any of our hosting plans (Lite, Standard, or Premium), you agree to the following:

• Services are provided on a monthly or yearly billing cycle at the rates displayed on our website.
• Yearly plans include a 10% discount applied automatically at checkout.
• All hosting accounts are subject to fair usage policies regarding storage, bandwidth, and server resources.
• Smikehost reserves the right to suspend or terminate accounts that violate our Acceptable Use Policy.

We guarantee 99% uptime for all hosting plans. In the event of downtime exceeding the guaranteed uptime, customers may be eligible for service credits as described in our Service Level Agreement (SLA).

Account Registration

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

Smikehost shall not be liable for any loss or damage arising from your failure to maintain the security of your account.

Payment & Billing

All payments are due at the time of service activation or renewal. We accept payments in both Nigerian Naira (₦) and US Dollars ($).

• Invoices are generated automatically and sent to your registered email address.
• Failure to pay within the specified grace period may result in service suspension.
• Refund requests must be submitted within 30 days of purchase for eligible services.
• Domain registrations are non-refundable once processed.

Acceptable Use Policy

You agree not to use Smikehost's services for any unlawful or prohibited activities, including but not limited to:

• Distributing malware, viruses, or other harmful software.
• Hosting phishing websites or engaging in fraudulent activities.
• Sending unsolicited bulk email (spam).
• Hosting content that infringes on intellectual property rights.
• Engaging in activities that could damage, disable, or impair our servers or network.

Violation of this policy may result in immediate account suspension or termination without refund.

Data Backup

While Smikehost performs routine backups of server data, it is your responsibility to maintain your own backups. We are not responsible for any loss of data due to hardware failure, software errors, or any other cause.

We strongly recommend that all customers maintain regular independent backups of their website data and databases.

Limitation of Liability

To the maximum extent permitted by applicable law, Smikehost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue.
• Loss of data or business opportunities.
• Service interruptions or downtime.

Our total liability for any claim arising from the use of our services shall not exceed the amount paid by you in the twelve (12) months preceding the event giving rise to the claim.

Modifications to Terms

Smikehost reserves the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications constitutes your acceptance of the updated terms.
